TERMS OF USE

  1. INTRODUCTION
    These Terms of Use (“Terms”) govern your access to and use of A Smart CV, a web-based application that allows users to store their career history and generate tailored CVs and cover letters (the “Service”). By accessing or using A Smart CV, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not access or use the Service.This Service is operated by A Smart CV Ltd, registered in England and Wales under company number 16308547, with registered address at 82A, James Carter Road, Mildenhall, IP28 7DE (“we”, “us”, “our”).
  2. DEFINITIONS
    Account” means a registered account with A Smart CV. “Content” means information, data, text, or other materials uploaded, inputted, or otherwise transmitted by you in connection with your use of the Service. “Personal Data” has the meaning given to it in the Data Protection Act 2018 and the UK GDPR. “Subscription” means the purchase of access to premium features of the Service for a defined period.
  3. ELIGIBILITY AND ACCOUNT REGISTRATION
    3.1 To use the Service, you must be at least 16 years of age and capable of forming a binding contract with us.
    3.2 You must provide accurate, current, and complete information during the registration process and maintain and promptly update this information.
    3.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
    3.4 You must notify us immediately of any unauthorised use of your account or any other breach of security.
  4. SUBSCRIPTIONS AND PAYMENT
    4.1 A Smart CV offers both free and paid Subscription plans, each providing different features and levels of access to the Service.
    4.2 By subscribing to a paid plan, you agree to pay all fees applicable to your selected Subscription.
    4.3 All payments will be processed through our third-party payment processor, Stripe. Your use of Stripe’s services is subject to Stripe’s terms and conditions.
    4.4 Subscriptions will automatically renew unless cancelled by you at least 24 hours before the end of the current billing period.
    4.5 We reserve the right to change our Subscription fees upon reasonable notice. Any price changes will apply to billing periods commencing after the notice period.
  5. USER CONTENT AND CONDUCT
    5.1 You retain ownership of all Content that you submit to the Service.
    5.2 By uploading Content, you grant us a worldwide, non-exclusive, royalty-free licence to use, store, and process your Content solely for the purpose of providing and improving the Service.
    5.3 You are solely responsible for all Content that you upload and warrant that: a) You own all rights to the Content or have proper authorisation to use it; b) The Content does not infringe any third-party rights; c) The Content does not violate any applicable laws or regulations.
    5.4 You agree not to: a) Use the Service to upload or share any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable; b) Attempt to gain unauthorised access to any part of the Service; c) Use the Service for any fraudulent or unlawful purpose; d) Interfere with the proper operation of the Service; e) Use automated means, including scrapers, bots, or similar technologies to access the Service; f) Submit false or misleading information in your Content; g) Attempt to reverse engineer, decompile, or otherwise attempt to extract the source code of the Service.
  6. FAIR USE POLICY
    6.1 The Service is intended for personal use by the registered account holder only. Creating CVs or cover letters on behalf of individuals other than the account holder is strictly prohibited.
    6.2 We expect users to maintain reasonable usage patterns. Excessive use, defined as usage significantly above the average user consumption patterns or that which places undue burden on our systems, may be considered a violation of this Fair Use Policy.
    6.3 Specific examples of excessive use may include, but are not limited to: a) Generating an unusually high number of CVs or cover letters within a short timeframe; b) Systematically creating multiple versions of similar documents when not reasonably needed for genuine job applications; c) Using the Service in a way that suggests commercial usage or usage on behalf of multiple individuals.
    6.4 We reserve the right to: a) Monitor usage patterns to ensure compliance with this Fair Use Policy; b) Temporarily limit or throttle access to the Service for users exceeding reasonable usage patterns; c) Suspend or terminate accounts that repeatedly violate this Fair Use Policy after receiving a warning.
    6.5 Before taking action under clause 5A.4(c), we will provide notice to the account holder and a reasonable opportunity to modify usage patterns, except in cases of fraudulent or clearly abusive behaviour.
  7. INTELLECTUAL PROPERTY RIGHTS
    7.1 The Service, including its design, features, functionality, and content provided by us, is owned by us and is protected by copyright, trademark, and other intellectual property laws.
    7.2 We grant you a limited, non-exclusive, non-transferable, and revocable licence to use the Service solely for your personal, non-commercial use.
    7.3 You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit the Service in any way without our prior written consent.
  8. AI-GENERATED CONTENT
    8.1 The Service uses artificial intelligence to analyse your Content and generate CVs and cover letters tailored to specific job descriptions.
    8.2 You acknowledge that AI-generated content may not be perfect and should be reviewed for accuracy, completeness, and appropriateness before use.
    8.3 We do not guarantee that AI-generated content will lead to job offers or improve your chances of employment.
    8.4 You retain the right to edit, modify, or reject any AI-generated content produced by the Service.
  9. PRIVACY AND DATA PROTECTION
    9.1 Our Privacy Notice, available here, forms part of these Terms and describes how we collect, use, and protect your Personal Data.
    9.2 We will process your Personal Data in accordance with the Data Protection Act 2018, the UK GDPR, and our Privacy Policy.
    9.3 Marketing Communications: If you are a customer who has purchased or subscribed to our Service, we may send you marketing communications about similar products or services that we offer. These communications are sent on the basis of our legitimate interest in keeping you informed about our product updates, features, and offers that may be relevant to your career needs. You have the right to opt out of receiving such communications at any time by:
    a) Clicking the ‘unsubscribe’ link in any marketing email;
    b) Adjusting your communication preferences in your account settings; or
    c) Contacting us directly at info@asmartcv.com.We will always provide you with a simple way to opt out and will respect your preferences. We will not share your Personal Data with third parties for their marketing purposes without your explicit consent.
  10. DISCLAIMERS AND LIMITATIONS OF LIABILITY10.1 The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.
    10.2 We do not warrant that: a) The Service will be uninterrupted, error-free, or secure; b) Any information provided will be accurate or reliable; c) The quality of any products, services, information, or other material purchased or obtained will meet your expectations.
    10.3 To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or relating to your use of the Service.
    10.4 Our total liability for any claims under these Terms, including for any implied warranties, shall not exceed the amount you paid us to use the Service during the 12 months preceding the claim.
    10.5 Nothing in these Terms excludes or limits our liability for: a) Death or personal injury caused by our negligence; b) Fraud or fraudulent misrepresentation; c) Any other liability that cannot be excluded or limited by English law.
  11. INDEMNIFICATION
    11.1 You agree to indemnify, defend, and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from: a) Your use of the Service; b) Your Content; c) Your violation of these Terms; d) Your violation of any rights of another person or entity.
  12. TERMINATION
    12.1 We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms or the Fair Use Policy.
    12.2 You may terminate your account at any time by following the instructions on the Service or contacting us.
    12.3 Upon termination, your right to use the Service will cease immediately, and we may delete your Content and account information.
    12.4 All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
  13. CHANGES TO THESE TERMS
    13.1 We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on the Service and/or by sending you an email.
    13.2 Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
  14. GOVERNING LAW AND JURISDICTION
    14.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.
    14.2 Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of England and Wales.
  15. GENERAL PROVISIONS
    15.1 These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.
    15.2 Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
    15.3 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
    15.4 You may not assign or transfer these Terms or your rights under these Terms without our prior written consent.
    15.5 These Terms do not create any agency, partnership, joint venture, employment, or franchise relationship between you and us.
